These Terms of Service ("Terms") govern your access to and use of BackpackOT, an online game and its associated website, account system, virtual currency ("Backpack Coins"), virtual items and related services (together, the "Service"), operated by an individual, without a separate registered legal entity for this project ("BackpackOT", "we", "us").
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Purchases of Backpack Coins are additionally governed by our Purchase Terms, and our handling of personal data is described in our Privacy Policy. Where the Purchase Terms address something specifically about a purchase, they take precedence over these Terms for that purchase.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that happens under your account. Please use a strong, unique password and keep it private.
You must provide accurate information where the Service requires it (for example, a valid email address for account recovery). If any information you provided becomes inaccurate, please update it.
Responsibility for account and character conduct follows BackpackOT's game rules; where those rules address account sharing, multi-accounting or similar topics in more detail, they apply alongside these Terms.
If you are under 18, you may generally use the Service, but any purchase of Backpack Coins requires the authorization of a parent or legal guardian where required by applicable law. See our Purchase Terms for details on purchases.
You agree to comply with BackpackOT's game rules, available on the Server Rules page, which are incorporated into these Terms by reference. Those rules cover topics such as prohibited character names and player conduct in more detail than is repeated here.
Without limiting the game rules, you agree not to: cheat or exploit bugs or unintended game mechanics; use bots, macros or other unauthorized automation; engage in fraud or manipulate game systems (including the economy, trading, or the Backpack Coin balance of any account); or engage in abusive conduct toward other players or staff.
If we reasonably believe you have violated these Terms, the game rules, or applicable law, we may take proportionate action, which can include warning you, restricting in-game or website functionality, suspending your account, or terminating your account.
We use reasonable discretion when deciding how to respond to a violation, taking into account its severity and context. Serious cases -- including significant exploits, fraud, chargeback abuse, or attempts to compromise the Service -- may result in immediate suspension without prior warning.
Characters, Backpack Coins, items, outfits, mounts, account progression and other virtual content ("Virtual Content") exist only within the Service. When you obtain Virtual Content, you receive a limited, personal, non-transferable right to use it within the Service, for as long as the Service and that content continue to exist. Virtual Content does not represent ownership of any part of BackpackOT, our software, or our infrastructure.
Backpack Coins have no cash value. They cannot be redeemed, exchanged or refunded for real-world currency, and are not a store of value, an investment, or a deposit. Backpack Coins obtained via purchase are digital content that you buy for use within the Service -- see our Purchase Terms -- they are not donations, and we do not refer to them as such.
BackpackOT is a continuously developed online game. To keep it fair, functional and enjoyable, we may change item statistics, spell values, monsters, quests, loot, rarity systems, vocation balance, maps and other content, progression systems, the functionality of virtual items, Backpack Coin shop offerings, and other game mechanics.
Purchasing or obtaining Virtual Content does not guarantee that it, or its exact attributes, will remain unchanged forever. Changes are made as part of the ordinary operation and development of the game, not to arbitrarily devalue what you have obtained, and we aim to make changes that keep the game balanced and enjoyable overall.
Operating the Service requires routine technical work. We may perform maintenance, temporarily interrupt availability, deploy updates, perform rollbacks, restore from backups, and correct duplicated or illegitimately obtained items or currency, exploits, or corrupted game state, in each case as reasonably necessary to operate the Service.
In exceptional circumstances -- such as a major exploit, severe economy corruption, database corruption, a catastrophic technical failure, a security incident, or another circumstance threatening the integrity of the game world -- we may roll back, partially reset, or fully reset game-world data.
We will make reasonable efforts to minimize unnecessary loss when this happens. Where technically and reasonably possible, Backpack Coins that were purchased but not yet used will be restored after a major reset, using our payment and account records. We cannot guarantee restoration is technically possible in every scenario, and we will communicate what we can if a reset affects your account.
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Maintenance, technical issues, or circumstances outside our control can cause temporary outages.
You may stop using the Service at any time. We may suspend or terminate your account for the reasons described in Section 4 (Enforcement), or discontinue the Service in the future, for example if it is no longer viable to operate. Where reasonably possible, we will provide notice before a full discontinuation of the Service.
Ending your access to the Service, or discontinuing the Service, does not remove any mandatory consumer rights you have under applicable law, including in relation to purchases already made.
We may update these Terms for legitimate reasons, such as changes in applicable law, security requirements, changes to the Service, or new functionality. We will make the updated Terms available on this page with an updated version number and effective date.
Where a change is material, we will take reasonable steps to bring it to your attention, and our systems are able to require you to actively re-accept the updated Terms before continuing to use account-related features of the Service where we determine that is appropriate.
These Terms and any dispute arising from or relating to BackpackOT shall be governed by the laws of Sweden.
If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection rights that apply to you under the laws of your country of residence.
Nothing in these Terms limits, excludes or purports to waive any right you have under applicable law that cannot lawfully be limited, excluded or waived, including mandatory consumer-protection rights.
